IMPORTANT: Emergency Unmerge uses proprietary algorithms to reconstruct pre-merge records. Results are probabilistic and NOT guaranteed to be 100% accurate. Executing an unmerge will create new records and modify properties in your HubSpot CRM. Recovery snapshots are saved automatically, and the built-in Property Editor allows you to correct fields after execution. By using this service, you acknowledge and accept that Third Space, LLC is NOT LIABLE for any data loss, data corruption, inaccuracies, or damages of any kind resulting from the use of Emergency Unmerge. You must review all reconstructed data before executing any changes to your CRM.

These Terms of Service ("Terms") govern your use of Emergency Unmerge by Third Space ("the Service"), a HubSpot record recovery tool operated by Third Space, LLC ("Thirdspace," "we," "us," or "our"). By installing, accessing, or using Emergency Unmerge, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

These Terms incorporate by reference our Privacy Policy and Acceptable Use Policy.

1. Service Description

Emergency Unmerge is a HubSpot CRM integration that provides:

Emergency Unmerge is a best-effort data recovery tool. It uses Anthropic's Claude to analyze HubSpot property history and reconstruct probable pre-merge record states. Results are probabilistic approximations, not guaranteed reproductions of the original data. The accuracy of reconstruction depends on the complexity of the merge, the availability of property history data, and the quality of algorithmic inference.

2. Account and Access

2.1. You must have an active HubSpot account to use Emergency Unmerge.

2.2. You must authorize Emergency Unmerge via HubSpot's OAuth 2.0 flow, granting the requested CRM data access scopes.

2.3. You are responsible for maintaining the security of your HubSpot account. Emergency Unmerge is not responsible for unauthorized access resulting from compromised HubSpot credentials.

2.4. You must be a Super Admin or have sufficient permissions in your HubSpot portal to install and configure Emergency Unmerge.

2.5. You represent and warrant that you have the authority to bind your organization to these Terms.

3. Credits and Billing

3.1 Credit System

Emergency Unmerge operates on a credit-based pricing model. There are no subscriptions or recurring charges. Buy exactly how many credits you need, or save with a bundle:

Credit costs per operation are determined by record complexity (number of associations, activities, and properties). Credit consumption per operation is determined by record complexity, as published on our documentation page. The free scan step shows the exact credit cost before any charge. Credit consumption rates may be adjusted from time to time; current rates are always available at emergencyunmerge.com/docs.

3.1a Self-Serve Purchase Limits

The maximum self-serve credit purchase is 25,000 credits ($1,000) per transaction. This limit applies to all self-serve checkout methods (per-credit purchases and bundles). If your project requires more than 25,000 credits, please contact our team at joshua@thirdspaced.com to arrange a custom volume purchase. We offer enterprise pricing and invoiced billing for large-scale unmerge projects.

3.2 What You Are Purchasing

YOU ARE PURCHASING A PROPRIETARY ANALYSIS OF YOUR MERGED RECORD DATA. THE ANALYSIS IS THE PRIMARY DELIVERABLE.

When you click "Generate Reconstruction Plan," credits are consumed to produce a detailed reconstruction analysis. This analysis includes property assignments, confidence scores, association mapping, and a downloadable JSON report. The analysis is the deliverable you pay for, not the optional execution step.

The reconstruction workflow has four stages:

  1. Scan (free): Identifies merged records and shows complexity/credit cost
  2. Reconstruction (credits consumed, point of no return): Generates the proprietary analysis
  3. Review: You inspect every property assignment and confidence score
  4. Execute (optional): Creates new records in HubSpot based on the analysis

You receive the full reconstruction analysis (including downloadable JSON) regardless of whether you choose to execute. Credits pay for the reconstruction analysis, not the execution.

EU/EEA/UK Consumers: By clicking "Generate Reconstruction Plan," you expressly request that the digital content (reconstruction analysis) be provided immediately. You acknowledge that you lose your right of withdrawal under Article 16(m) of the EU Consumer Rights Directive once the reconstruction analysis begins, as the digital content has been fully provided.

Australian Consumers: Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Where our services fail to meet a consumer guarantee, you are entitled to remedies under that law.

3.3 Credit Expiration

Credits do not expire. Once purchased, they remain available on your account indefinitely.

3.4 Refunds

ALL CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE, EXCEPT AS EXPRESSLY STATED BELOW OR AS REQUIRED BY APPLICABLE LAW.

Emergency Unmerge credit refund rules:

Chargebacks: Filing a chargeback or payment dispute for a legitimate credit purchase constitutes a violation of these Terms. We reserve the right to suspend your account, forfeit remaining credits, and pursue recovery of the disputed amount plus any chargeback fees incurred.

Remedies in lieu of refunds: In cases of partial system failure or degraded reconstruction quality, we may, at our sole discretion, issue courtesy credits. This is not an obligation and does not create an expectation of future credits.

Exceptions required by law: Notwithstanding the above, if you are located in a jurisdiction where mandatory consumer protection laws require refund rights that cannot be waived by contract (e.g., EU Consumer Rights Directive, Australian Consumer Law), those statutory rights apply to the extent they provide greater protection than these Terms. 3.5 Payment Processing

All payments are processed by Stripe, Inc. By purchasing credits, you agree to Stripe's Terms of Service. We do not store credit card numbers.

4. Reconstruction Process

YOU ACKNOWLEDGE AND AGREE THAT:

Emergency Unmerge sends the following data to Anthropic's Claude for analysis:

4.2 Data Handling by Processing Provider

Data sent to Anthropic is subject to Anthropic's Acceptable Use Policy and Privacy Policy. Per Anthropic's commercial API terms:

If pre-merge snapshots are available on the record, Emergency Unmerge may use them to enhance reconstruction accuracy. The use of snapshots is automatic and does not change the credit cost.

5. No Guarantees of Accuracy or Completeness

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THIRD SPACE, LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

5.3 HubSpot API Limitations - New Record Creation

Due to limitations in HubSpot's API, Emergency Unmerge cannot restore the original merged record. Instead, it creates a new HubSpot record with the reconstructed properties. As a result:

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRD SPACE, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

IN NO EVENT SHALL THIRD SPACE, LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE CREDITS USED IN THE SPECIFIC OPERATION GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Third Space, LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

8. Recovery JSON Snapshots

8.1. For every unmerge execution, Emergency Unmerge automatically captures pre-execution and post-execution JSON snapshots of all affected HubSpot records (including all properties and associations). These snapshots are stored alongside the operation results and are available for download via the API.

8.2. Recovery snapshots are provided as a courtesy for manual developer-assisted restoration only. They are NOT an undo feature. If you or your development team need to reverse changes, the snapshots provide a reference of the record state before and after the unmerge, but restoring records from snapshots requires manual effort using the HubSpot API.

8.3. Third Space, LLC makes no guarantees regarding the completeness or accuracy of recovery snapshots, and is not responsible for any issues arising from manual restoration attempts using snapshot data.

8.4. Recovery snapshots are retained as part of the operation record. You are responsible for downloading and saving snapshots for your own records if long-term retention is needed.

10.1. Emergency Unmerge, its source code, algorithms, and user interfaces are the property of Third Space, LLC.

10.2. You retain ownership of all your CRM data. We claim no ownership rights over your HubSpot data.

10.3. "Emergency Unmerge," "Third Space," and related branding are trademarks of Third Space, LLC.

11. Termination

11.1. You may stop using Emergency Unmerge at any time by uninstalling it from your HubSpot portal.

11.2. We may terminate or suspend your access at any time for violation of these Terms or for any other reason at our sole discretion.

11.3. Unused credits are not refundable upon termination, except as required by applicable law.

11.4. Sections 5, 6, 7, 8, and 10 survive termination.

12. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. For EU/EEA consumers, mandatory consumer protection laws of your country of residence apply to the extent they provide greater protection. Any disputes shall be resolved in the state or federal courts located in Texas.
